Eligibility - Applying for an Indian Work Permit

Most non-Indian nationals relocating to India to take up a position of employment will have an Indian company in place to sponsor them and they will be relocating to India to perform a specific role. All applicants must be able to provide a current, valid passport from their country of residence and it must be established that the candidate has sufficient financial support throughout the period of time they will be spending in India. Candidates will also have to provide a range of supporting documentation and must give details of the employer and position they will be engaged in whilst in India. Work permits do not provide a route to permanent residency in India, however they may be extended a year at a time as required.

Indian Intra Company Transfer Visas – Applying for an ICT

In India, visas for intra company transfers or ICT’s allow an Indian based company to transfer skilled employees from an overseas subsidiary or branch to work on a specific project in India. In most cases, ICT applicants will be expected to have a sufficient level of educational qualifications, usually this means a four year university degree. As with Indian work permits, ICT applications have loosely defined guidelines and will be granted on a case by case basis subject to the Indian migration officer’s discretion. However, the granting of an ICT visa will take into account whether or not any native Indian citizens or Indian permanent residents will be displaced by the foreign national working in India.

Spouse Immigration and Dependent Immigration

Although an Indian work permit does not constitute a route to permanent settlement, the option to renew the permit on a yearly basis is available and as a result a work permit applicant may potentially work in India for a number of years. Accordingly, the immediate family members of the principle applicant may join him or her in India. The spouse and/or dependent children of a work permit holder may enter the country and remain in India for the same duration awarded to the main applicant. However, such dependents will not be permitted to seek and undertake employment and in order to work in India they will need to obtain individual Indian work permits.
